Terms of Service

1. Who These Terms Apply To

These Terms of Service (and the End-User Licence Agreement embedded within them) apply between you and LifeLight Studios, the publisher of the NeoNest™ app (the "App").

If you are using NeoNest on behalf of a kennel, business, or other organisation, you confirm that you have the authority to bind that organisation to these Terms.

2. Age Requirement

You must be at least 13 years old (16 in the European Union or United Kingdom) to use NeoNest. If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf and supervise your use of the App.

3. What NeoNest Does

NeoNest is a neonatal puppy care management app for breeders and pet owners. It helps you:

• Track puppy weight, growth, feeding, and milestones
• Monitor early-warning signals via EWS, DamGuard, LifeShield, and Colostrum Lock
• Follow guided emergency playbooks via NeoRescue
• Get hands-free voice support from NeoNanny inside The Nest
• Walk through the 8-week journey via WhelperPath
• Connect with other breeders in our community

4. Licence to Use the App (EULA)

Subject to these Terms, LifeLight Studios grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use NeoNest on devices you own or control, solely for your personal or kennel-business use.

You agree not to:

• Reverse-engineer, decompile, or disassemble the App except where local law permits
• Modify, adapt, or create derivative works of the App
• Rent, lease, sublicense, or sell access to the App
• Remove any copyright, trademark, or proprietary notices
• Use the App in any way that violates applicable law or these Terms

All rights not expressly granted are reserved.

5. Your Account

You can use NeoNest anonymously or sign in with Apple, Google, Facebook, X, or TikTok. Your account is yours.

• You are responsible for the security of your account and any activity that occurs under it
• Use accurate information when signing up
• Tell us right away if you suspect unauthorised use

6. Keeping Everyone Safe

We're all about safeguarding — for puppies and people. The community side of NeoNest (chat rooms, friend requests, video calls) is moderated.

Please don't:

• Use the App for anything illegal or harmful
• Try to access other people's data
• Share false or misleading health information that could endanger an animal
• Be unkind in chats and rooms — treat others with respect
• Reverse-engineer, scrape, or otherwise interfere with the App's systems
• Impersonate someone else or misrepresent your identity
• Upload content you don't own the rights to

We may remove content, suspend, or terminate access if we believe someone's safety is at risk or these Terms have been violated.

7. Intellectual Property

NeoNest, including its name, logo, graphics, audio voice clips, the NeoNanny knowledge base, source code, design, and all features, is owned by LifeLight Studios and protected by copyright, trademark, and other intellectual property laws.

Please don't copy, modify, or distribute any part of the App without written permission.

8. Your Content

You retain ownership of everything you create in the App — puppy profiles, photos, notes, storybook entries, the lot. By enabling cloud sync you grant us a non-exclusive, royalty-free licence to host, transmit, and display your content solely for the purpose of providing the service to you.

This licence ends when you delete your content or your account. We never use your content for advertising, training models, or anything other than providing NeoNest to you.

9. Subscriptions & Payments

The safety stack of NeoNest (EWS, NeoRescue, A&E mode, Nest, Colostrum Lock, DamGuard, LifeShield, WhelperPath day counter) is free — we believe life-safety features should never be paywalled.

How billing works

• Subscriptions are billed by Google Play (Android) or Apple App Store (iOS), not by LifeLight Studios directly. Your subscription receipt and refund eligibility are governed by your store's terms.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled at least 24 hours before the period ends.
• Free trial: The 7-day free trial converts to a paid subscription unless cancelled before the trial ends. To cancel before the trial converts, use your store's subscription settings.
• Price changes: If we change the subscription price, we'll notify you in advance through the app or by email. Your continued subscription after the change takes effect means you accept the new price.
• Cancelling: You can cancel any time via your store's subscription settings. Cancelling stops future renewals; you keep Pro access until the end of the current billing period.

Refunds

• Refunds for in-app purchases and subscriptions are handled by Google Play and the Apple App Store under their respective refund policies.
• Google Play: request a refund at support.google.com/googleplay (typically allowed within 48 hours of purchase, longer for verified issues).
• Apple App Store: request a refund at reportaproblem.apple.com.
• If you're in the UK or EU and your statutory cancellation rights are stronger than the store policy, those statutory rights still apply.

10. Disclaimers

The App is provided "as is" and "as available". To the maximum extent permitted by law, LifeLight Studios disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that it will meet your specific requirements. Always keep your own backups of important records.

11. Limitation of Liability

To the maximum extent permitted by law, LifeLight Studios will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the App.

Our total liability to you for any claim arising out of these Terms or your use of the App will not exceed the greater of (a) the amount you paid LifeLight Studios in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law (including, in the UK, your rights under the Consumer Rights Act 2015).

12. Account Termination

You can delete your account at any time via the in-app option or by emailing privacy@neonest.app. Full details on the Data Deletion page.

We may suspend or terminate access if you violate these Terms, abuse community features, or engage in illegal activity. We will give reasonable notice unless immediate suspension is necessary to protect users or comply with law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced inside the App or by email. The "Last updated" date at the top of this page reflects the most recent change. Continued use after a change takes effect means you accept the updated Terms.

14. Apple App Store-Specific Terms (iOS users)

If you obtained NeoNest from the Apple App Store, you also acknowledge:

• These Terms are between you and LifeLight Studios only, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
• You represent and warrant that you are not located in a US-embargoed country and are not on any US government list of prohibited or restricted parties.

15. Google Play-Specific Terms (Android users)

If you obtained NeoNest from Google Play, your use is also subject to the Google Play Terms of Service. To the extent any provision of those terms conflicts with these Terms, the Google Play Terms control with respect to your relationship with Google.

16. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident in the UK or EU retain the right to bring proceedings in the courts of their country of residence under applicable consumer-protection law.

17. Severability

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force.
